## The statute, on the fee
Source: Freedom of Information and Protection of Privacy Act, R.S.O. 1990, c. F.31, and
R.R.O. 1990, Reg. 460.

Section 24(1)(c) of the Act requires that a request be accompanied by the fee prescribed by
the regulations. Section 5.2 of Regulation 460 sets that fee at $5. Neither the section nor
the regulation prescribes the instrument of payment. The restriction to cheque or money order
is the Foundation's own.

Section 57(1) of the Act lists the fees an institution shall require — search, preparation,
computer costs, shipping, and other costs of responding. Section 57(4) requires the head to
waive payment of an amount required under section 57(1) where it is fair and equitable, and
paragraph 2 of section 8 of Regulation 460 names, among the prescribed matters, "If the amount
of a payment would be $5 or less, whether the amount of the payment is too small to justify
requiring payment."
