Request under the Access to Information Act — what instrument obliges anyone to defend Canada, and what happens if it ends
Hello,
This is a request under the Access to Information Act.
I am a person present in Canada and entitled to make this request under subsection 4(1) of the Act as extended by the Access to Information Act Extension Order, No. 1.
Period covered: 1 January 2024 to the date this request is processed.
I request the following records.
1. Any record identifying the instrument in which an obligation of any state to defend Canada against nuclear attack is recorded, or stating that no such instrument exists
2. Any record concerning the consequences for the defence of Canada of two events. The termination of the Agreement on the North American Aerospace Defense Command of 28 April 2006 under its 12-month notice provision. The denunciation of the North Atlantic Treaty by any Party under Article 13 of that Treaty
3. Any record concerning contingency planning for a reduction, conditioning or withdrawal of United States participation in the defence of North America
4. Any record assessing statements made publicly by officials of the United States on three subjects. The annexation of Canada. The accession of Canada as a state of the United States. An alteration of the international boundary
5. Any record concerning whether Article 5 of the North Atlantic Treaty obliges any Party to respond to a nuclear attack on Canada with nuclear weapons
Please limit the search to briefing notes, memoranda to the Minister, option papers, assessments, analyses and contingency plans. Please exclude media monitoring and news clippings.
If no records responsive to any numbered item exist, I request that your response state that expressly, item by item.
I request a waiver of the application fee under subsection 11(6) of the Act. I receive social assistance under the Ontario Works Act and have no discretionary income. If the waiver is refused, tell me how to pay and I will pay the fee. If it is refused, I request the reasons in writing together with the criteria applied.
I prefer to receive records electronically.
Respectfully,
