Request for internal review of the decision of 2 September 2026 - the shelter allowance - Danilo Dzyuban
Hello,
Danilo Dzyuban. This is a request for an internal review under section 27 of the Ontario Works Act, 1997 and section 69 of Ontario Regulation 134/98.
THE DECISION UNDER REVIEW.
The decision of the Social Assistance Intake Unit for the Ontario Works Administrator dated 2 September 2026, reference RE [number], which approves my application for financial assistance as of 5 June 2026 and sets the first payment at 1,326.27 dollars. That decision states that a request for internal review must be made in writing by 6 October 2026. This request is within time.
WHAT I ASK TO BE REVIEWED.
The amount. Not the approval, which I accept, and not the effective date, which I accept.
Section 41 (1) of Ontario Regulation 134/98 makes budgetary requirements the sum of paragraph 1, basic needs, and paragraph 3, the amount payable for the cost of shelter calculated under section 42. The payment of 1,326.27 dollars consists of 4 lines and every one of them is basic needs: 297.27 for 5 to 30 June and 343.00 for each of July, August and September. Paragraph 3 was paid at zero for every month.
Section 42 (2) sets the maximum monthly shelter allowance for a benefit unit of 1 at 390 dollars and makes the amount payable the lesser of the actual cost and that maximum. My shelter cost is 390 dollars a month, invoiced by Catholic Centre for Immigrants Ottawa, invoice AR-00981-RC. For July, August and September the shelter allowance is 1,170 dollars.
For June, section 40 (2) (a) requires a determination that has never been made. Paragraph (b) prorates basic needs and paragraph (a) does not prorate shelter.
WHAT THE DECISION ON REVIEW MUST CONTAIN.
Section 71 (2) of Ontario Regulation 134/98 requires the decision on internal review to include the original decision, a statement of whether it is confirmed, set aside or varied, reasons, and the effective date. I ask for all 4 elements.
I ask that the decision of 2 September 2026 be varied to include the shelter allowance under section 41 (1) paragraph 3 from 5 June 2026 forward.
