Fwd: Access to Information Act request — general records (NPower Canada funding terms, YESS)
Hello,
The attachment is below, as received by ESDC on 28 July 2026 at 20:14 UTC at the address it publishes for access requests. Section 6 of the Access to Information Act requires a request in writing to the institution. That requirement was met on 28 July 2026, and the 30 day period under section 7 has run from that date. ESDC is in deemed refusal under subsection 10(3) since 28 August 2026.
ESDC now writes that it no longer holds the request it received. The Information Commissioner's notice of 21 September 2026 requires ESDC to keep every record relating to the allegation under investigation. State in writing on what date the attachment was lost, which officer disposed of it, and under what authority. Destroying or concealing a record with intent to deny a right of access is an offence under section 67.1 of the Act.
The mail route offered on 23 September 2026, 57 days after the request, requires a cheque or money order. I hold a Visa Debit card and nothing else. The online portal refuses debit cards. ESDC has named no method of paying 5 dollars that is open to me, and that is the failure under subsection 4(2.1) that the Commissioner is investigating. The attached letter applied for a waiver of the fee under subsection 11(2) on 28 July 2026. ESDC has not decided it.
I require 3 things by 30 September 2026. Registration of the request with 28 July 2026 as the date of receipt and the file number by return. A written decision on the waiver under subsection 11(2). If the waiver is refused, a method of paying 5 dollars by debit card, in person or otherwise.
This letter and ESDC's answer go to the investigator on file 5826-03149. After the Commissioner reports, the matter goes to the Federal Court under section 41.
Respectfully,
Danilo Dzyuban
