Re: Response to your ATIP request P-2026-40785 made with the Canada Border Services Agency / Réponse à votre demande d’AIPRP P-2026-40785 faite auprès de l’Agence des services frontaliers du Canada
Hello,
Privacy Act request P-2026-40785. The release of 24 September 2026 answers item 1 of the request. It says nothing about items 2 and 3. Section 16 (1) of the Act requires a statement that a record does not exist, or the provision relied on. Neither was given.
Confirm in writing by 8 October 2026 the 4 points below.
First, item 3. The search located no record of any communication between the Agency and the Ontario Ministry of Children, Community and Social Services or any Ontario Works office concerning me. Name the offices searched.
Second, item 2. No record exists of a removal interview, a removal date, a determination on the Administrative Deferral of Removals to Ukraine in my case, or a notification under section 160 (3) of the Immigration and Refugee Protection Regulations. The release shows one entry, "Eligible for PRRA", status "Not Started", dated 8 June 2026, case Z000214020. State whether that status has changed since 9 September 2026.
Third, section 19 (1) (a). Name the foreign institution. The released notes record contacts with United States Customs and Border Protection on 22 January 2025 and 9 May 2026. State whether the Agency asked that institution for consent under section 19 (2) (a). If it did not, ask now and report the answer.
Fourth, missing records. The Vancouver Enforcement officer's note of 16 May 2026 records that on 5 May 2026 he emailed my photograph to an employee of the Cyrus Centre in Chilliwack, a private shelter. The shelter's records, released to me on 22 September 2026 under the British Columbia Personal Information Protection Act, record receipt of that email. That email, the reply, the exchanges with the Chilliwack, White Butte and Whistler RCMP (file WP25-374), and the request to United States Customs and Border Protection of 9 May 2026 are records under the Agency's control about me. None is in the release. Produce each one, or state the provision under which it is withheld. State the paragraph of section 8 (2) under which my photograph went to a private shelter.
If the 4 points are not answered by 8 October 2026, a complaint goes to the Privacy Commissioner of Canada under paragraphs 29 (1) (a) and 29 (1) (h), with this letter and the release attached.
Respectfully,
Danilo Dzyuban
