A decision on submission 4276171 and the record of online filings in London against the standard of three days.

The letter ·

Small Claims Court London - submission 4276171 undecided since September 12, 2026 - decision required by October 8, 2026

Hello,

This is for the Assistant Deputy Attorney General, Court Services Division, McMurtry-Scott Building, 720 Bay Street, Toronto.

The Division's Small Claims Court office in London has broken the Division's own published standard twice in the same matter, and does not answer the plaintiff in writing.

The record:

- September 12, 2026: submission 4276171 filed through Small Claims Court Submissions Online, with a fee waiver request.
- Ontario.ca: court staff review online submissions within 3 business days.
- September 20, 2026: written demand to the London office for the Claim Number or a written refusal by September 23, 2026.
- September 24, 2026: no Claim Number, no refusal, no answer.
- Before that: submission 4239334, filed on August 26, 2026, was answered on September 8, 2026, the eighth business day. It set 3 conditions. All 3 were met before submission 4276171 was filed.

The Division sets the standard. The Division answers for the office that breaks it.

By October 8, 2026, which is 10 business days under the Division's own service standards, the Division will:

1. Decide submission 4276171: issue the Claim Number, or give the written reason for refusal.
2. Name the Manager of Court Operations responsible for the London courthouse.
3. Produce the Division's record of how online submissions at the London courthouse perform against the 3 business day standard, including 4239334 and 4276171.

If submission 4276171 is not decided by October 8, 2026, I will apply to the Divisional Court for an order in the nature of mandamus under the Judicial Review Procedure Act to compel the clerk to decide it. This correspondence will be the record before that court.

Respectfully,
Danilo Dzyuban
