Court security funding for Ottawa, 2024 to 2026: the funding letters, the reports and the criteria.
The letter ·
Court Security and Prisoner Transportation program - City of Ottawa records and the regulation under paragraph 4 of subsection 243 (1)
Hello,
The Ministry administers the Court Security and Prisoner Transportation transfer payment program. Each year the Province, represented by the Solicitor General, enters into a Transfer Payment Agreement with each funded municipality. The municipality uses the funds only for eligible activities and reports back on the Annual Financial and Performance Measurement Report template the Ministry provides.
Send me the following records:
1. Transfer Payment Agreements with the City of Ottawa for 2024, 2025 and 2026, with the funding letters that set their terms
2. Annual Financial and Performance Measurement Reports the City of Ottawa submitted for 2023, 2024 and 2025
3. The allocation of program funding to every recipient municipality for 2024, 2025 and 2026, with the cost figures behind each allocation
4. The criteria the Ministry uses to decide which activities the program pays forThe Community Safety and Policing Act, 2019 makes the police service board responsible for the level of security at court premises. Paragraph 4 of subsection 243 (1) requires the board to determine it "in accordance with the regulations, if any". Paragraph 65 of subsection 261 (1) gives the Lieutenant Governor in Council the power to make a regulation governing that determination. Section 13 of O. Reg. 399/23 requires the chief of police to prepare a court security plan and to establish procedures on supervision and training. It sets no standard for the level of security.
Name the regulation that governs the determination of appropriate levels of security under paragraph 4 of subsection 243 (1). If no such regulation has been made, confirm that in writing.
