Submission 4276171 - 12 days undecided - Manager of Court Operations to answer by October 1, 2026
Hello,
This is for the Manager of Court Operations, London courthouse.
The London Small Claims Court office has held submission 4276171 for 12 days without a decision. The claim and fee waiver request were filed on September 12, 2026 through Small Claims Court Submissions Online. Ontario.ca sets the review standard at 3 business days. The office has missed it by at least 5 business days.
On September 20, 2026 I demanded the Claim Number or a written refusal by September 23, 2026. The office did not answer.
This is the second breach in this matter. Submission 4239334, filed on August 26, 2026, was answered on September 8, 2026, the eighth business day. That answer set 3 conditions. All 3 were met before submission 4276171 was filed. The office has no outstanding condition to point to.
This is a formal complaint under the Court Services Division service standards. The 3 business day standard expired long ago. The office gets 5 more business days, not 10.
By October 1, 2026, the office will:
1. Issue the Claim Number for submission 4276171, or give the written reason for refusal.
2. Name the staff member who holds the submission and state the date it reached the clerk.
3. Name the Manager of Court Operations answering this complaint, with position. The limitation period does not stop while this office sits on an unissued claim. The Assistant Deputy Attorney General, Court Services Division, receives this matter today. If the office does not answer by October 1, 2026, I will apply to the Divisional Court for an order in the nature of mandamus under the Judicial Review Procedure Act to compel a decision.
Respectfully,
Danilo Dzyuban
