Re: Civilian Review and Complaints Commission for the RCMP R2026-008858 Danilo Dzyuban

Hello,

Public complaint R2026-008858. The Commission put 2 questions on 29 September 2026. The answers come from the file the Canada Border Services Agency released to me under the Privacy Act on 24 September 2026, file P-2026-40785.

1. THE REASON FOR THE ARREST.

CBSA officers arrested me in Ottawa on 22 May 2026 on an immigration warrant under subsection 55 (1) of the Immigration and Refugee Protection Act. The warrant is dated at Vancouver, 11 May 2026. CBSA entered it in its case system on 20 May 2026. The ground marked on the warrant is "unlikely to appear" for an admissibility hearing. The CBSA arrest record reads "Reason Arrested: Proceedings by IRCC/CBSA" and "Arrest Grounds: Will Not Appear". CBSA released me the same day on conditions. The warrant and the arrest record allege no criminal offence.

2. THE CONNECTION BETWEEN THE STOP AND THE ARREST.

The CBSA file gives the sequence.

On 6 May 2026 the member took my name and date of birth and ran them. By her own account she then had her staff contact the Chilliwack Detachment. A CBSA officer in Vancouver, Inland Enforcement Officer J. Alldred, had spoken to the Chilliwack Detachment about me on 5 May 2026. The warrant was signed 5 days after the stop.

On 16 May 2026 the same CBSA officer telephoned the member. He wrote her account into a solemn declaration made at Vancouver that day. The declaration records that I was "doing some unusual behaviour in a business parking lot". It records that the member "originally thought he was impaired by substances" and, after talking to me, "perhaps mental health issues". It records: "She believes that he likely does not have any funds and is more likely hitchhiking across the country". The passage closes with these words: "Statutory declaration added to both GCMS and NCMS as he will likely be arrested in another province."

The member's account is the only entry in the declaration that places me outside British Columbia. It is the only source in the declaration for the statements on my funds and my means of travel. CBSA put the declaration into 2 national systems, GCMS and NCMS, and gave the reason in the words quoted above. 6 days later CBSA arrested me in another province, on the ground that I would not appear.

When CBSA first learned of the stop, and from whom, the released pages do not show. That record is with the RCMP. The investigation must establish what the White Butte Detachment sent about me between 6 May and 16 May 2026, and to whom.

The complaint is against the conduct of the member on 6 May 2026 and on 16 May 2026. The arrest shows where her statements went and what they were used for.

WHAT IS REQUIRED BY 16 OCTOBER 2026.

1. Confirm in writing that complaint R2026-008858 has gone to the RCMP for investigation under subsection 45.6 (1) of the Royal Canadian Mounted Police Act. State the date of the notice to the Commissioner under subsection 45.53 (10).

2. Put the complaint before the Chairperson for a decision under subsection 45.66 (1), and send me that decision in writing.

3. Where the Commission refuses to deal with any part of the complaint, name the paragraph of subsection 45.53 (2) and give the reasons in writing.

A refusal goes to the Federal Court under section 18.1 of the Federal Courts Act.

Respectfully,

Danilo Dzyuban
