Brief on Bill C-31, Part 4, Division 16: Defence Investment Agency Act, section 12, for the meetings of 6 and 7 October 2026

The brief follows below. It concerns section 12 of the Defence Investment Agency Act, enacted by clause 290 of Bill C-31, which the Committee examines as a whole.

Section 12 lists five considerations that bind the Minister. The location of production is absent from the list. The brief sets out one amendment to section 12 and one to clause 337.

The same brief went to the Standing Senate Committee on National Security, Defence and Veterans Affairs on 30 September 2026 for its report on Division 16. Under point 5 of the order of the Senate of 10 June 2026, the Committee is authorized to take that report into consideration during its study of the subject matter of all of Bill C-31. The brief is placed before the Committee directly so that the amendment is before the members who examine the bill as a whole.
