Re: RE: Response to your ATIP request P-2026-40785 made with the Canada Border Services Agency / Réponse à votre demande d’AIPRP P-2026-40785 faite auprès de l’Agence des services frontaliers du Canada

Hello,

Privacy Act request P-2026-40785. This answers your message of 28 September 2026.

Items 2 and 3 are items of the request, not questions. Item 2 of the request of 27 July 2026 reads: "any record of a scheduled removal interview, removal date, or Pre-Removal Risk Assessment notification issued to me (or any record confirming that none has been issued)". Item 3 covers every email and letter between the Agency and Ontario Works, or its ministry, about me.

The release of 24 September 2026 holds no record under item 3. It holds no record of a removal interview, a removal date or a PRRA notification, and no statement that none exists. Subsection 16 (1) of the Act governs a refusal. The notice must state that the information does not exist, or name the provision relied on. For items 2 and 3 the notice does neither.

Your office did not task the Pacific Region. The request covers all records about me held by the Agency. Its time limit, extended under paragraph 15 (a) (i), ended on 25 September 2026. Under subsection 16 (3), the Pacific Region records are deemed refused. Among them is the email of 5 May 2026 that sent my photograph to the Cyrus Centre in Chilliwack, with its reply. The exchanges with the Chilliwack and Whistler RCMP on file WP25-374 are Pacific Region records too. The release also omits the request of 9 May 2026 to United States Customs and Border Protection.

A complaint under paragraphs 29 (1) (a), (b) and (h) has been before the Privacy Commissioner since 28 September 2026.

By 8 October 2026, give the notice under subsection 16 (1) for item 2 and for item 3. By the same date, state when the Pacific Region was tasked and the date its records will be released.

This letter and the Agency's answer, or its absence, go to the Commissioner's file. After the Commissioner's report, the next step is the Federal Court under section 41.

This exchange goes into the public record at https://dzyuban.com/legal/record/requests/

Respectfully,

Danilo Dzyuban
