RE: Your Access Request with Justice Canada - X-P-2026-00081 - Clarification Required
Hello,
File X-P-2026-00081. The letter of 6 October 2026 rests on 3 statements, and none of them stands against the Privacy Act.
1. The Department holds personal information about me, and its own chapter of Info Source says where. It lists the standard banks Access to Information and Privacy Requests, PSU 901, and Public Communications, PSU 914. In 2026 I made requests to the Department under the Access to Information Act, including those of 29 August, 4 September and 30 September. On 15 September 2026 the Department sent me 3 fee waiver refusals, one for each open request, and on 21 September 2026 it named the deciding official. Those records are personal information about me in PSU 901. My letters to the Minister are in PSU 914.
2. The request is complete. Subsection 13(1) requires a request for personal information in a bank to identify the bank, and item 3 names PSU 901 and PSU 914. Items 1 and 2 name the files. No further clarification is owed.
3. Subsection 8(2) of the Privacy Regulations requires identification before access is provided, and it does not suspend processing. A copy of my Ontario Photo Card is attached.
The Department received the request on 28 September 2026, and the 30 days under section 14 end on 28 October 2026. The Privacy Act contains no provision under which a request is abandoned. The date of 20 October 2026 has no basis in the Act.
By 28 October 2026 the Department does 2 things.
1. Confirms in writing that the request is processed as written from 28 September 2026, PSU 901 and PSU 914 included.
2. Gives access to the records, naming for each withholding the provision relied on, as subsection 16(1) requires. An answer not given by 28 October 2026 is a refusal under subsection 16(3). The complaint then goes to the Privacy Commissioner of Canada under paragraph 29(1)(b), and the matter to the Federal Court under section 41.
This exchange goes into the public record at https://dzyuban.com/legal/record/requests/
Respectfully,
