URGENT - Contempt of the Interim Assistance Order of 21 August 2026 by the City of Ottawa - SBT file 2608-06747 - Danilo Dzyuban

URGENT: ONGOING CONTEMPT OF THE TRIBUNAL'S INTERIM ASSISTANCE ORDER OF 21 AUGUST 2026 BY THE CITY OF OTTAWA
UNILATERAL USURPATION OF TRIBUNAL JURISDICTION BY A MUNICIPAL CASEWORKER

Danilo Dzyuban, SBT file 2608-06747. Attached are my written submissions on the City of Ottawa's defiance of the Interim Assistance Order of 21 August 2026, filed under the Notice of Videoconference Hearing of 21 August 2026 for a ruling before the hearing. A copy goes to the Director, Social Assistance Intake Unit, under Rule 5.8, and to the City of Ottawa, the delivery agent that is defying the order.

A municipal caseworker has cancelled an order of this Tribunal. On 19 October 2026 Jean-Pierre Kunstenaar, City of Ottawa, closed my file and terminated the payments the Tribunal ordered. He wrote to my housing provider that my file "is now closed" and that "there will be no more funds issued to him or to CCI". On 23 October 2026 at 11:54 the same caseworker wrote to me in MyBenefits: "I must meet with you in person and you must provide all your documentation." That is ultra vires administrative extortion. A municipal caseworker has no legal authority to impose a procedural ransom on a binding Tribunal order. The payments this Tribunal ordered are held hostage behind an in-person meeting and documents that the order does not require.

The order states that the amount "shall not take into account any income, assets or conditions of eligibility disputed in this appeal" and that "Only the SBT can cancel or vary this decision for interim assistance." The City has cancelled it by its own act, through a municipal caseworker, with no objection to the Registrar and no notice to me. The shelter amount of $1,170 for August to October 2026 is unpaid. The last payment was $343 on 1 October 2026. The payment for November 2026 falls due on 1 November 2026, and the City has announced in writing that it will not be made.

The Tribunal has had this contempt before it since 29 September 2026, in my letters of 29 September, 16 October and 19 October 2026, and has not answered. The deadline of 23 October 2026 set in them passed with no ruling. Every day of the Tribunal's silence the City of Ottawa treats a binding order of this Tribunal as a conditional offer subject to its own process. By maintaining silence, this Tribunal moves from neutral adjudicator to passive accomplice in the City's open defiance of the law.

By remaining silent since 29 September 2026, the Tribunal is actively permitting the City of Ottawa to void an SBT order. Subsection 23 (1) and section 25.0.1 of the Statutory Powers Procedure Act arm the Tribunal to stop this abuse of its process today, before the hearing. If this Tribunal refuses to enforce its own order by issuing the directions sought in Part E of the attached submissions by 31 October 2026 at 5:00 PM, this institutional abdication of statutory duty goes to the Divisional Court under the Judicial Review Procedure Act, as mandamus against the Tribunal itself. Tribunals Ontario is subject to the investigative jurisdiction of the Ombudsman of Ontario. This institutional failure to enforce a statutory mandate goes there as a systemic administrative failure requiring external intervention. A municipal caseworker does not overrule an Ontario tribunal with impunity.

Delivery to the Respondent is confirmed: this email and its attachments go to the Director, Social Assistance Intake Unit, at [email] at the same time, and to the City of Ottawa.
