RE: Written testimony on Bill C-22 filed 2 September 2026 — receipt, translation and the date it reaches members

Attention: Emily Barrette, Committee Clerk, Standing Senate Committee on Legal and Constitutional Affairs.

Hello,

On 24 September 2026 the Committee confirmed that the testimony of 2 September 2026 on Bill C-22 is filed and will be translated and circulated to members on the order of reference. This supplement adds 1 document to that filing.

THE DOCUMENT.

On 2 September 2026 I put 3 provisions of Bill C-22 to the Office of the Privacy Commissioner of Canada and asked whether the Office will address them at the Senate stage. The provisions are subsection 487.0195(3) of the Criminal Code, section 22.07 of the Mutual Legal Assistance in Criminal Matters Act, and the absence of any reporting obligation in Part 1.

The Office answered on 29 September 2026, file INFO-122474. The answer in full on the substance: "the OPC does not have any further information to share at this time beyond the Commissioner's statement published on May 26, 2026."

It names none of the 3 provisions. The federal privacy regulator has had them in writing for 27 days and has taken no position. Clause 11 lets a foreign statute deliver data about a person in Canada to Canadian police with no Canadian judicial authorization. On 29 September 2026 the regulator's position on that clause does not exist in writing.

The answer of the Office is attached in full, with its headers.

WHAT IS REQUIRED BY 9 OCTOBER 2026.

1. File this supplement with the testimony of 2 September 2026 as 1 submission, and confirm that in writing.

2. Send both for translation now and state the date. They must reach the members on the day of the order of reference.

3. Name the rule or practice under which translation waits for the order of reference, where the Committee holds that it does.

Without that confirmation the supplement goes to the Chair and the Deputy Chair of the Committee directly.

Respectfully,

Danilo Dzyuban

The answer ·

Good afternoon Mr. Dyzuban,

As Bill C-22 has not been referred to the Standing Senate Committee on Legal and Constitutional Affairs at this time, and as there is discussion as to which committee the bill will be referred following second reading, I am not sending submissions to translation in advance of the bill being referred to this committee. This is to avoid duplicating the work of the Translation Bureau and to prioritize requests related to current orders of reference.

If the bill is referred to this committee, submissions received in advance of the referral will be sent for translation without delay.

Submissions can be sent directly to senators at any time, and their contact information is available on the Senate of Canada's website.

Kind regards,
