Re: Bill C-22 submission of 2 September 2026 — consent to publication, circulation to members and transfer on referral
Attention: Ericka Paajanen, Clerk, Standing Senate Committee on National Security, Defence and Veterans Affairs.
Hello,
This supplement adds 1 document to the submission on Bill C-22 of 2 September 2026. The 4 requirements of 24 September 2026 stand, with their date of 1 October 2026.
THE DOCUMENT.
On 2 September 2026 I put 3 provisions of Bill C-22 to the Office of the Privacy Commissioner of Canada and asked whether the Office will address them at the Senate stage. The provisions are subsection 487.0195(3) of the Criminal Code, section 22.07 of the Mutual Legal Assistance in Criminal Matters Act, and the absence of any reporting obligation in Part 1.
The Office answered on 29 September 2026, file INFO-122474. The answer in full on the substance: "the OPC does not have any further information to share at this time beyond the Commissioner's statement published on May 26, 2026."
It names none of the 3 provisions. The federal privacy regulator has had them in writing for 27 days and has taken no position. Clause 11 lets a foreign statute deliver data about a person in Canada to Canadian police with no Canadian judicial authorization. On 29 September 2026 the regulator's position on that clause does not exist in writing.
The answer of the Office is attached in full, with its headers.
WHAT IS REQUIRED BY 9 OCTOBER 2026.
1. File this supplement with the submission of 2 September 2026 as 1 document, and confirm that in writing.
2. Post both on the Committee's website and circulate both to the members by email, and state the 2 dates.
3. Where the Senate refers Bill C-22 to another committee, send both to that committee and name the committee and the date.
Without that confirmation the supplement goes to the Chair and the Deputy Chair of the Committee directly.
Respectfully,
Danilo Dzyuban

Hello,
Thank you for your additional submission.
We will add it to your previous document and have it translated. However, please note that I am not authorized to post this to the website since the committee has not been referred Bill C-22. Only if and when the committee receives the bill can we share with members and post publicly.
Thank you.
