SBT file 2608-06747 - assistance stopped on 23 September 2026 while the Interim Assistance Order of 21 August 2026 stands - Danilo Dzyuban

Hello,

Danilo Dzyuban, SBT file 2608-06747. A copy goes to the Director, Social Assistance Intake Unit, under Rule 5.8.

On 21 August 2026 the Tribunal directed the Director to pay interim assistance from 1 August 2026 to 31 January 2027 under section 30 of the Ontario Works Act, 1997. The order states: "Only the SBT can cancel or vary this decision for interim assistance."

On 23 September 2026 the City of Ottawa, Social Support Centre - Central, put the file on hold. Its letter, signed for the Ontario Works Administrator, states: "You will not receive Ontario Works and other benefits while your file is on hold."

The Tribunal has delivered no decision that cancels or varies the order.

The ground given is: "We did not receive information about your earnings this month." No message and no letter in MyBenefits asks for earnings information. The last message from the office, of 3 September 2026, asked for bank statements and a lease, and they went to the office on 6 September 2026. MyBenefits sent no notice of the letter of 23 September 2026 to my email, and the letter was found in the portal on 29 September 2026. The Income page of MyBenefits refuses the report: "you cannot report income because you do not have a job or training program on file." On 29 September 2026 the information was delivered through MyBenefits: earnings for September 2026 are nil.

No condition of eligibility under section 30 (2) of the Act has failed. Section 14 (1) of the Act allows the administrator to suspend assistance only "as prescribed". Ontario Regulation 134/98 prescribes no suspension for an unfiled report. Its section 14 (1) and (4) provide for a determination of ineligibility, and the respondent made none. The word "suspend" stands in the Regulation once, in section 68, on the death of a member of the benefit unit.

(1) Confirm in writing that the Interim Assistance Order of 21 August 2026 is in force.

(2) Direct the respondent to pay the assistance for October 2026 and to state the payment date in writing.

(3) Direct the respondent to name the provision of Ontario Regulation 134/98 that prescribes the suspension of 23 September 2026.

(4) State in writing the step the Tribunal takes when a respondent stops paying under its order.

Answer by 6 October 2026. After that date the stoppage goes to the Divisional Court under the Judicial Review Procedure Act and to the Ombudsman of Ontario.

Respectfully,
Danilo Dzyuban
